Data Protection and Privacy Policy

Bensitur - Sociedade Açoriana de Investimentos Turisticos Lda., legal entity and registration number 512 012 210, registered with the Commercial Registry of Ponta Delgada, headquartered at L. Vasco Bensaude, 13-matriz, 9500 Ponta Delgada, and with the capital EUR 274.34 (BENSITUR”), processes personal data within the scope of activities carried out on the website www.parqueterranostra.com as well as all its subdomains (from now on referred as "Website"), that is, information relating to a natural person identified or identifiable ("Data Subject(s)"), considering identifiable a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, data location, electronic identifiers or one or more specific elements of the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person ("Personal Data").

BENSITUR, whenever determining the purposes and means of processing Personal Data, will be qualified as responsible for the processing of Personal Data, ensuring compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, and other applicable legislation on data protection and privacy ("Data Protection Legislation").

Therefore, this Data Protection and Privacy Policy ("Privacy Policy") is established, with BENSITUR committing itself to carry out any processing of Personal Data in accordance with the provisions of the following points:

B.      DISCLOSURE AND TRANSMISSION OF PERSONAL DATA


BENSITUR team members will process the Personal Data of the Data Subjects for the performance of their work functions and will treat the Personal Data exclusively under the terms specified in this Privacy Policy.


Personal Data may be made available to third parties in charge of providing services to BENSITUR ("Subcontractors"), bound by a written contract and processing the data under the terms of this Privacy Policy, not being able to process them directly or indirectly, for any other purpose, for their benefit or that of a third party.

Data Subjects have the right to obtain a complete and updated list of Subcontractors (if any) contracted by BENSITUR. For this purpose, they must send a specific request to BENSITUR under the terms specified in Point E of this Privacy Policy.


In compliance with legal obligations, the Personal Data of Data Subjects may be transmitted to third parties for the pursuit of their purposes, namely banks and insurance companies, judicial, administrative, supervisory, or regulatory authorities, and also entities that lawfully carry out compilation actions of data, efforts to prevent and combat fraud.


C.     INTERNATIONAL TRANSFERS


BENSITUR may transfer the Data Subject's Personal Data outside the European Economic Area ("EEA") to locations that may not guarantee the same level of protection.


However, if applicable, BENSITUR will only transfer Personal Data outside the EEA, namely, per one of the following measures: (i) if the transfer is carried out to a location or through a method or in circumstances that the European Commission deems to ensure adequate protection of Personal Data; (ii) if you have implemented standard data protection contractual clauses approved by the European Commission or by a competent supervisory authority; or, (iii) if none of the previous options applies, but the law still authorizes such transfer, for example, if it is necessary for the declaration, exercise or defense of a right in a legal proceeding.

You may request detailed information on the security measures that BENSITUR has implemented regarding transferring Personal Data outside the EEA and, when applicable, a copy of the standard data protection contractual clauses in force at BENSITUR through the contacts made available in Point E.

D.     RIGHTS OF THE DATA SUBJECTS


Under current or future Data Protection Legislation, BENSITUR informs that Data Subjects may exercise their rights of access, rectification, opposition, deletion, portability, and limitation of treatment, as well as the right not to be subject to individual automated data decisions and any other rights that are recognized by law concerning the treatment. If the basis of legitimacy for the processing of Personal Data is consent, the Data Subjects may withdraw consent, at any time, without any consequences arising from there, but without this compromising the lawfulness of the treatments carried out in the meantime. If consent is withdrawn, BENSITUR will immediately cease processing Personal Data for the purpose in question unless there is a need to process the data to comply with legal and/or contractual obligations. Likewise, Data Subjects are informed that they can submit any claim or request related to protecting their personal data to the National Data Protection Commission.


Data Subjects may, at any time, in writing, exercise the rights enshrined in the Data Protection Legislation and other applicable legislation through the means described in Point E of this Privacy Policy.
